CrowdSense Single for desktop, CrowdSense Service for desktop, and CrowdSense Cloud for the web are referred to as “Software” below.
Software licenses
Once activated, licenses for CrowdSense Single desktop software cannot be revoked. One desktop software license can be activated on one PC only. Change of PC, motherboard, or network adapter will lead to invalidation of the CrowdSense Single license.
Payments and refunds
All payments received for CrowdSense Single desktop software licenses become non-refundable once the corresponding licenses are activated on users' machines. A CrowdSense Service subscription can be stopped or cancelled by setting the number of channels and extra storage to zero in the billing section.
Trademarks
CrowdSense and other marks indicated on the site are trademarks of CrowdSense or its affiliates. The trademarks and trade dress may not be used in any way likely to cause confusion among customers or that disparages CrowdSense. All other trademarks not owned by CrowdSense that appear on the site are the property of their respective owners.
Termination
CrowdSense may terminate your use or registration with or without cause at any time without notice. In the event of a breach by you of these Terms of Service, termination shall be in addition to and without prejudice to any other rights and remedies available to CrowdSense. The disclaimer, limitations on liability, indemnity, and termination provisions shall survive the termination of these Terms of Service.
Dispute resolution
CrowdSense will do its best to resolve any dispute in a satisfactory manner. If unable to resolve a dispute, either party shall submit the matter to mediation. If mediation fails, the parties shall be free to pursue any right or remedy available under applicable law.
Indemnity
You agree to indemnify and hold harmless CrowdSense, its parents, subsidiaries, affiliates, customers, vendors, officers, and employees from any liability, damage, or cost arising out of your breach of these Terms of Use or your violation of any law or right of any person or entity.
Registration process
When you submit your registration, you will create a password-protected account. You agree to keep your account information and password confidential and are responsible for all activities under your account. One account can be used by only one person. Inform CrowdSense immediately about any suspected unauthorised use of your account.
Age of users
CrowdSense does not intend for the site to be used by individuals under the age of 18 without the supervision of a parent or guardian 18 years of age or older.
Disclaimer
The software is provided "as is" without warranty of any kind, either expressed or implied. Use of CrowdSense software is done at your own discretion and risk. You are solely responsible for adequate protection and backup of data and equipment used in connection with the software.
Additional Notices
CrowdSense makes no warranty that the software will meet your requirements, be uninterrupted, timely, secure or error-free, or that results will be accurate or reliable. In no event shall CrowdSense be liable for any special, punitive, incidental, indirect, or consequential damages arising out of the use of the software.
